As we reported earlier, the prosecution met with David page only two weeks before Clinton’s scheduled execution. In this taped interview, Page admitted to kidnapping the second victim. Although he does not completely exculpate Clinton, Page is revealing more and more of the truth.
We now know exactly what Page said, because we have the State’s reply to Clinton’s Writ of Habeas Corpus.
Why is it so important that David Page admitted to the kidnapping? Because Clinton was convicted for it. To convict someone for capital murder, you need at least one aggravating factor. Kidnapping can be such a factor. In Clinton’s case there were 2 aggravating factors. When Clinton can proof he did not kidnap the second victim, at least one factor is off the table. When Clinton can proof he did not kill the second victim, he can’t be convicted for capital murder. No capital murder means no death penalty.
